TELEVISION X ULTIMATE PACKAGE HALF PRICE PROMOTION TERMS
1. This Promotion in respect of the “Television X Ultimate Package” is administered and entered into by RHF Productions Limited a company registered in Jersey (registered number 77483) whose registered office is at First Floor, Orviss House, Queen Street, St Helier, Jersey JE2 4WD (“Promoter“). Viewers wishing to order the “Premier Package” will instead be subject to a contract with Portland Enterprises (CI)Limited under the terms set out here http://www.televisionx.co.uk/join-now/sky/terms-and-conditions.
2. The Promotion is open to any viewer (“Viewer“) being a current BSkyB television viewer resident in the UK and Northern Ireland of 18 years of age or older, who is currently subject to a valid and binding UK adult television ongoing subscription package agreement with a provider other than the Promoter broadcasting on the BSkyB platform (“Other Provider“). The Promotion is not open to employees (or their families) of RHF Productions Limited, its agencies or any other company or person commercially connected with the Promotion.
3. This promotion (“Promotion“) offers to Viewers an annual subscription to the Television X “Ultimate Package” on a monthly payment basis in accordance with these Promotion rules, for a discounted price (ie the current normal price is £15.99 per month, which will be discounted to £7.99 for Viewers), subject to the Promoter’s standard Customer Terms and Conditions which can be found here http://www.televisionx.co.uk/join-now/sky-ultimate/terms-and-conditions. The Viewer agrees and understands the Promoter’s right to substitute alternative programming to that previously advertised and/or to withdraw any Channel(s) or reduce the number of hours of content included in any Channel or to encrypt/decrypt any Channel from time to time (Promoter agreeing to use all reasonable endeavours to ensure that such changes shall be kept to a minimum) pursuant to paragraph 3 of the Promoter’s current standard Customer Terms and Conditions. Accordingly, the parties acknowledge that the Promoter’s current intention is to change the number of channels provided in the “Ultimate Package” from 10 channels to 7 channels from 21/05/09.
4. This Promotion is not transferable and there is no cash alternative.
5. This Promotion cannot be used in conjunction with any other discount or offer.
6. This Promotion is subject to the Promoter’s customer Terms and Conditions. By subscribing to TVX Ultimate Package for an annual subscription, in accordance with this Promotion, Viewers will be deemed to have i) read and understood and to have agreed to these Promotion rules and the Promoter’s standard Customer Terms and Conditions which can be found here http://www.televisionx.co.uk/join-now/sky-ultimate/terms-and-conditions and Privacy Policy which can be found here http://www.televisionx.co.uk/privacy.
7. The parties acknowledge that nothing in this Agreement will require, solicit or induce any Viewer to terminate or breach any term of their contractual relationship with any Other Provider. Viewer will indemnify Promoter against any and all claims, losses or costs incurred by the Promoter as a direct or indirect result of any such breach or termination.
8. Viewers who have not previously registered for the “Television X” branded channels will, at the time the Viewer applies for the Promotion, first register with the Promoter, such registration subject to a one-off non-refundable fee.
9. Prices include VAT, and are expressed in pounds sterling.
10. The Promoter reserves the right at any time to terminate or modify or extend the Promotion and modify these Promotion rules immediately upon notice.
11. This Promotion shall be governed and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction.
